Attorneys Say Exes are Turning to Facebook for Evidence in Divorce & Custody Cases

In an article posted on the Atlanta Journal-Constitution’s website, 81% of divorce attorneys surveyed said they’ve seen an increase in the use of Facebook and other social networking sites as ammunition during a
divorce or
child custody dispute. Compromising photos, questionable notes or messages to another man or woman, and juicy chat conservations can and are all being used as evidence in divorce and child custody cases.
While all social networking sites are being used by spouses eager to gather incriminating information, Facebook is by far the most widely used social networking site. In fact, 66% percent of attorneys surveyed by the American Association of Matrimonial Lawyers said Facebook produces the most evidence.
So what should you take away from this blog post? If you have a Facebook page and you are filing for divorce or seeking custody of your children, delete your account. Even if you think you are covering all of your bases, your ex may still find ways to gain access to your account. And while California is a no fault state when it comes to divorce, you can rest assured a judge would be very interested to see what you’ve been doing and who you’re spending time with when children are at the center of a dispute.
